The Costa Rican Constitution has been modified gradually from 1949, but it is in 1989 when it happens a deep political reform, with the creation of the Constitutional Chamber of the Supreme Court of Justice. The modifications to the constitutional articles 10, 48, 105 and 128, and the approval of the Law N° 7.135, establishes a new system of constitutional adjudication. This new institutional design is rooted in the theory of separation of powers, but also in the democratic foundations of Constitutional Courts as guarantors of the citizens' fundamental rights.

The investigation studies the Constitutional Amendments passed before 1989 that were impugned at the Constitutional Court, between that year and 1997; this with comparative purposes with the amendments approved according the new rule: the Constituent now must consult its proposals to the Constitutional Chamber. It was found that the Constitutional Chamber has not been limited alone to point out procedure aspects, but rather has also noticed to the Legislative Assembly on the matter of the proposals. The procedural corrections are of obligatory observance for the Assembly, but a political incentive has also been generated so that the legislators attend other recommendations of Constitutional Court. The Mandatory Consultation of Constitutionality becomes in a sort of political control. This way then, in 1989 new checks and balances were settled down in the Costa Rican Political System.
