This dissertation discusses the belief, common among German lawyers of the Romantic era, that the use of Roman law could somehow provide solutions to the political difficulties of the German states. Most politically active men in nineteenth-century Germany were trained Roman lawyers. Many of these men believed that the strict application of Roman law by the German courts would recreate a Roman social order in Germany, an order liberal in its way but untouched by political confrontation or revolutionary upheaval. The first two Chapters of the dissertation serve as background, tracing some of the history of the use of Roman law in the Holy Roman Empire. These early Chapters show how German Roman lawyers from the sixteenth-century onward thought of Roman political tradition as a fund of models for the reordering of German society. Chapters III, IV and V show how early-modern faith in the saving political power of Roman law revived among lawyers like G. Hugo, F. K. von Savigny, K. S. Zacharia and G. F. Puchta. Focusing on agrarian law, these Chapters evaluate the successes and failures of these lawyers. Finally, Chapter VI discusses the attempts of R. v. Jhering, B. Windscheid and their contemporaries to create a Roman commercial law in the years after 1848.Subjects--Topical Terms:
