520 $a This thesis draws from theoretical perspectives in the sociology of law and the sociology of deviance to analyze the implementation of Canada's initial narcotics legislation in 1908, and subsequent changes to that legislation over a 54-year period. I analyze the societal reaction to drugs and drug offenders in Canada as a whole, and in five Ontario cities in particular.
520 $a I initially examine the distinctions between "consensus" and various forms of "conflict" approaches in the literature on the sociology of law. Here, I address the difficulties of using an instrumentalist Marxist approach in explaining Canadian narcotics legislation. I use qualitative data from a number of different historical sources to argue that the legislative approach to narcotic drugs in Canada has been characterized by the influence of certainly socially powerful individuals and public bureaucracies who were able to translate their specific concerns into legislative policies,
520 $a The thesis also focuses on the "law in action"--how police officials enforced the narcotics legislation, and how the courts sentenced apprehended narcotics offenders. I employ both qualitative and quantitative data to examine how the legislative policies were translated into the discretionary enforcement decisions of the courts with respect to narcotic drugs. This analysis stresses that an examination of the exercise of discretion in the criminal justice system must give detailed consideration to the contexts of this decision-making. While the exercise of discretion at the level of police decisions appears to have resulted in discrimination against minority and lower-class drug users, logistic and hazard regression analyses of the decisions of judicial officials reveal that this discrimination was tempered to some extent in the courts, where such offenders were sentenced to less severe sentences. These findings have significant implications for theories of law formation, theories regarding the exercise of police discretion, the important factors to consider in conducting analyses of criminal sentencing, and the need to conduct historically informed empirical analyses of law that employ both qualitative and quantitative data.
