Accidents resulting from teacher negligence are an unfortunate part of physical education. Negligence committed by physical education teachers is a legitimate concern, because it can result in student injury, as well as lawsuits in tort resulting in significant monetary awards for victims.

This study, grounded in the theoretical perspective of interpretivism, explores a pivotal dimension of the question of whether personal injuries to students involved in physical education in schools should be governed by a pure tort system, a no-fault insurance system or a mixed system. This is important because the literature suggests that the current tort system, with its attendant fear of litigation, has led to physical education teachers adopting excessive risk management practices.

Through a series of one-on-one interviews conducted with a sample of Ontario physical education teachers, it was determined that the tort system has not led to excessive risk management, and, furthermore, that the educational benefits---both curricular and otherwise---to be gained from the adoption of a no-fault or mixed system are minimal.
