Over the past several decades, a number of studies have been conducted on employment discrimination. While much of this research has provided evidence of declining gender and racial inequality, overall, change arising from such general, diffuse factors as federal legislation and government oversight has been relatively slow and the effects uneven across workplaces. This project, drawing on both organizational and inequality theory, examines organizational change processes resulting from strong, coercive pressure in the form of discrimination lawsuits. Because organizational structures tend to become less variable over time, change is unlikely to occur in the absence of strong external pressure. Using establishment-level data based on EEO-1 reports covering a fifteen-year period (1983–98), the influence of discrimination litigation on the representation of women and minorities in the retail supermarket industry is explored. The project includes two sets of analyses: one, using a sample of organizations and their establishments directly involved in a successful lawsuit and the second, involving all other establishments in the retail supermarket industry. The first study is primarily designed as a test of the organizational theory of resource dependency while the focus of the second is on the more broadly defined institutional environment. The results indicate that especially for women and Latinos employed in establishments directly involved in litigation, a lawsuit filing in progressive federal court jurisdictions increases managerial representation. For those establishments in the more general organizational field, a lawsuit filing is also shown to positively influence managerial structures but only for women. The implications of these findings in terms of both policy and research are discussed.
