In this dissertation, I have endeavored to look at China's handling of the cancellation of the unequal treaties within the context of the early Republic's domestic developments. Differing from conventional "high diplomacy" studies of foreign policy-making and diplomatic negotiations, I have shifted attention to the institutional changes of the diplomatic infrastructure, patterns of bureaucratic professionalism, the interaction of diplomatic discourse and internal political culture, and the relations of the Beiyang diplomats and warlords.

In the review of these issues in relationship to the abolition of the unequal treaties, this thesis represents my reconsideration of the first period of the Chinese parliamentary experience and the problems which persisted in the later Nationalist era and the People's Republic. Increasingly seeing post-1949 China as a continuous part of instead of as a total rupture from earlier Chinese history, more and more scholars have begun to re-appraise Republican China, especially its relevance to contemporary China's modernization and democratization. If the rule of law, civil society, and ordered government are viewed as the central problems facing today's China, it should be remembered that they had their origins in the failed efforts of constitutionalism in the early twentieth century Republic of China.
