John Rawls has famously developed a conception of 'justice as fairness,' wherein the lexical ordering of his two principles of justice serves as a rubric by which to evaluate the overall justice of the central institutions of a society. This paper examines the political and moral relationship between parents, children, and the state in an attempt to flesh out a schema of educational rights and duties most likely entailed by Rawlsian Liberalism. Great attention is given to the conflict between religious parents and state mandated secular schooling, focusing on the interpretations of William Galston, Amy Gutmann, and Shelly Burtt on Yoder v. Wisconsin and Mozert v. Hawkins. Part two of the paper tackles the public vs. private education debate, in which Rawls is placed in dialogue with Adam Swift. Situated amongst these theorists, I conclude that 'justice as fairness' advocates an autonomy facilitating system of fully integrated public education.
