Toplantı ve gösteri yürüyüşü düzenleme hakkı, barışçıl gerçekleşmesi şartıyla Anayasamız ve taraf olduğumuz Avrupa İnsan Hakları Sözleşmesi tarafından herkese tanınmıştır. Ancak şiddetin egemen olduğu bir toplantı veya gösteri yürüyüşü hakkın korumasından faydalanamaz. Toplantı ve gösteri yürüyüşü düzenleme hakkı, özerk bir uygulama alanına sahip olsa da ifade özgürlüğü ışığında değerlendirilmelidir. Dolayısıyla demokratik toplumun temelinde yatan açık fikirlilik, hoşgörü ve çoğulculuk değerleri göz önüne alınarak hakka yaklaşılmalıdır. Toplumun genelini ve devleti rahatsız eden, abartılı, şoke edici ve marjinal fikirler toplantı ve gösteri yürüyüşü esnasında dile getirilebilir ve devletin bunların ifade edilmesini korumak gibi bir pozitif yükümlülüğü vardır. Toplantı ve gösteri yürüyüşü düzenleme hakkı ancak kanunla öngörülen, meşru amaçlara dayanan ve demokratik toplumda gerekli olduğu hallerde sınırlanabilir. Avrupa İnsan Hakları Mahkemesi'ne göre hakkın sınırlanmasındaki meşru amaç ile toplantı ve gösteri yürüyüşü hakkı arasında adil bir denge sağlanmalıdır.

520 3 $a The right to organize meetings and demonstrations has been granted to everyone by our Constitution and the European Convention on Human Rights to which we are a party, provided that it is peaceful. However, a meeting or demonstration march dominated by violence cannot benefit from the protection of the right. Although the right to organize meetings and demonstrations has an autonomous application area, it should be evaluated in the light of freedom of expression. Therefore, the right should be approached taking into account the values of open mindedness, tolerance and pluralism underlying the democratic society. Exaggerated, shocking and marginal ideas that disturb the general public and the state can be expressed during the meeting and demonstration march, and the state has a positive obligation to protect their expression. The right to organize meetings and demonstrations can only be limited when required by the law, based on legitimate purposes and necessary in a democratic society. According to the European Court of Human Rights, a fair balance must be struck between the legitimate aim of restricting the right and the right to march for meetings and demonstrations.
