Since 2011, the Middle East and North Africa (MENA) region has encountered significant direct and indirect changes in almost all countries and societies. What was named the Arab Spring in an optimistic view of positive changes in the political and economic systems in the region that ended in violence and civil war in some cases and an incompetent government in others. This power vacuum in some of the region's countries was the perfect chance for organized criminal groups to accelerate their transnational illegal activity within the region and far beyond. Organized criminal groups benefit from corruption in facilitating their activities, working without fear of arrest or prosecution, diverting attention to competitors, and directing laws and government actions to their favor. Rampant and persistent corruption is a significant factor that has angered the public and provoked economic and political issues. Corruption also exacerbated the situation in the region by serving as a facilitator for other transnational organized crime. Here, this research argues that the anti-corruption policies in the region fail to combat corruption, which remains an issue that could ignite further violence and instability in the area. However, in this thesis I investigate the regional impact of corruption on the Middle East and North Africa-MENA region and the efforts to combat corruption in the public sector that can be exploited by transnational organized crime groups. Transnational organized crimes (or "TOCs") can have adverse effects on national, regional, and global social and economic development, as well as on human rights, peace, security, and general stability. The dissertation aims to provide recommendations that will help prevent and combat corruption to minimize the threat of transnational organized crime and stimulate stability in the post-Arab Spring era. The dissertation investigates and answers the following questions: (1) What is the trend of transnational organizations in the MENA region; (2) How does corruption interact with transnational organized crimes; (3) How effective are the anti-corruption policies in the region; and (4) What lessons can be learned from the best anti-corruption practices at the international level? A policy-oriented jurisprudence methodology is the perfect research approach to analyze and respond to the problem we are trying to solve. Developed by Professor Myers McDougal and Professor Harold Lasswell at Yale Law School, the approach adapts the analytical approaches in social sciences to the perspectives of the law that are suitable to any field of the law; it deals with the law as a process of deciding, which needs an interdisciplinary methodology looks into the social process with a wider consideration of its participants, their interests, the base of power and strategy-where the decisions are made-and the outcome of that interaction in terms of the eight values that all the human beings pursue: power, affection, rectitude, well-being, enlightenment, respect, wealth, and skill.
