This dissertation examines the creation, evolution, and function of admiralty courts situated in the French colonies of North America and the West Indies from the late seventeenth century to the end of the eighteenth century. The admiralties were specialized tribunals whose jurisdiction extended not only to legal cases concerning the law of the sea but also to the administrative regulation of nautical traffic. First created in the ports of metropolitan France as a means of asserting royal sovereignty over maritime affairs, admiralty courts were established in the colonies in 1717 following a long jurisdictional battle. Engaging with underutilized judicial sources located in French and Canadian archives, this project tracks the development of the colonial admiralties from wartime prize courts to administrative institutions responsible for integrating the colonies into a shared trans-Atlantic economic space while simultaneously maintaining them as separate legal zones subject to special rules relating to foreign trade, debt obligations, Indigenous relations, citizenship, and slavery. In such a way, the colonial admiralty courts served as the primary vehicle through which the French monarchy asserted its sovereign legal authority over ports and seascapes of the Americas. This study reconfigures our understanding of how early modern empires were constructed by centring the analysis on law and judicial institutions as a vehicle of colonization, staking imperial claims to maritime as well as territorial space.
