This paper examines the fundamental principles of intellectual property laws, focusing on determining patent and copyright subject matters. By analyzing the historical developments of patents and copyrights, it illustrates that intellectual creations are inherently incorporeal and separate from their physical products and demonstrates that patents and copyrights are essentially the creators' statutory rights in their creations as incorporeal existences. Based upon this notion and the proper interpretation of Baker v. Selden, this paper introduces a new determination of patent and copyright subject matters. This new approach concentrates on the incorporeal creations themselves, in particular, whether a creation is aiming to functionalities or expressions. It aims to reconcile the ongoing controversies of overlapping protections of patents and copyrights, particularly in the realm of computer software, by restoring the authority of Baker. The proposed determination honors the fundamental principles of intellectual property laws while adapting to the complexities of modern creations, ensuring clarity and balance between creators' rights and public interests.
