In the Christian understanding, marriage was instituted by God and sanctified by Christ in a special way. Hence, marriage was considered to be good in itself, because this goodness was grounded as a visible sign of the intimate and loving relationship of Christ and his Church. This thesis delves into the notion of partial simulation contra bonum fidei. The first chapter presents an overview of the notion of bonum fidei, by looking at its historical and doctrinal development through the biblical and magisterial teachings. The second chapter expounds the concept of simulation in general and accomplishes an exegetical study of the relevant canons in 1917 code and 1983 code, and its canonical legislations and jurisprudence. The third chapter deals with unity as an essential property of marriage and analyzes the vitiation of matrimonial consent due to the exclusion of unity and exclusivity, and the exclusion of the right to fidelity from the jurisprudential point of view. It will also offer a short excursus on the elements of proofs used for handling such cases in matrimonial tribunals.
