This study sought to identify the perceptions of law enforcement personnel regarding how they conduct the essential functions of their job with the enactment of or potential enactment of new legislation eliminating the defense of qualified immunity in civil lawsuits. A mixed-methods research approach was employed, collecting quantitative and qualitative data through a survey. This data was analyzed and supported by unobtrusive data collected from each police department regarding their insurance agreements as well as contractual and statutory indemnity provisions. The population consisted of law enforcement officers from Colorado and Florida through a purposive sampling approach. The law enforcement officers completed the surveys, and the researcher compared to determine whether the elimination of qualified immunity impacts how they perform the essential functions of their job. There is no significant statistical difference between the perceptions of law enforcement officers in Colorado and Florida regarding how they perform their job despite the presence or absence of qualified immunity.
