本文從法律解釋的基本原理入手，從香港特別行政區的憲制地位研究和分析香港特別行政區法院基本法解釋權的特點。通過挖掘基本法解釋權制度立法原意，借鑒歐洲法院先決裁判制度的合理成分以及英國立法權和司法權的互動機制，檢視和分析香港特別行政區法院行使基本法解釋權遇到的實踐問題，從而得出完善基本法解釋條款運行機制的有關建議。本文認為，香港基本法不僅是一部全國人民代表大會通過的基本法律，而且具有維護"一國兩制"方針"五十年不變"的政治意義，不能動輒修改基本法。應通過完善基本法解釋方法、改進基本法解釋程序、完善有關制度機制，來完善基本法解釋權條款。同時，應啟動和用好香港基本法委員會制度的法定作用，確保基本法解釋權條款良性運行。

520 $a Starting with the basic principles of legal interpretation, the purpose of this article is to study and analyze the characteristics of the power of the courts of the Hong Kong Special Administrative Region to interpret the Basic Law in light of the constitutional status of the Hong Kong Special Administrative Region. By digging into the original legislative intention of the system of the power of interpretation of the Basic Law, with reference to reasonable elements of the European Court of Justice's preliminary ruling system and the interactive mechanism between legislative and judicial powers in the UK, practical problems encountered by the courts of the Hong Kong Special Administrative Region in exercising the power of interpretation of the Basic Law are examined and analyzed, and relevant suggestions to improve the operating mechanism of the interpretation clauses of the Basic Law are obtained. The author believes that the Hong Kong Basic Law is not only a basic law passed by the National People's Congress, it has the political significance of maintaining the principle of "one country, two systems" unchanged for 50 years, and cannot be amended frequently. It is necessary to improve the power of interpretation clauses of the Basic Law by improving the methods of interpretation of the Basic Law, the procedures of interpretation of the Basic Law and the relevant systems and mechanisms. At the same time, the legal role of the Hong Kong Basic Law Committee system should be activated and properly used to ensure the sound operation of the power of interpretation clauses of the Basic Law.
