Billions of dollars are illegally gambled each year, money that could be potentially taxed and used for public use. This qualitative case study focused on exploring the lack of revenue generation and the exclusion of new revenue streams due to an absence of pro-gambling laws in states without sports betting legalization. The theoretical framework that guided this qualitative case is the public choice theory. For economists that study the public choice theory, the legislative actions taken by lawmakers are analyzed using the principle of self-interest in which it is assumed people are primarily focused on themselves. A qualitative case study was appropriate for this study because much of the data needed comes from the state lawmakers that have the direct ability to affect the problem. Twelve state lawmakers were interviewed for this study using open-ended, predetermined questions. In the data collection process, there were a combination of interviews with state lawmakers, review of documents that include newspaper articles and data sets showing sports betting revenue in states' gaming reports, and observations that included a session at a casino sportsbook. Data analyses started with the search for patterns and themes by reading and re-reading the transcripts. The results of this case study provided findings in which three themes were identified from the research questions. The first theme that was identified was legalizing sports betting would increase revenue for the state. The second theme that was identified was sports betting legalization was a possible revenue source for education. Libertarianism was revealed as the third theme. The implications of the findings suggested that state governments would financially benefit from passing pro-gambling laws, and that most of the participants believe that legalizing sports betting will help the economy. The results from the participants were consistent with the public choice theory, consistent with the literature, and consistent with the purpose of the study. The recommendations include contacting state lawmakers during their state's legislative session, avoid conducting interviews in an election year, and emphasizing confidentiality.
