The hostility -comprised in a series of anti-immigration politics- that European governments display towards refugees, migrants, asylum seekers reaching the borders of Europe and the concomitant problems that these people are facing in claiming and exercising their rights poses an enigma before us. The frequency of the cases where people are 'left to die' in the Mediterranean and the number of derogations from non derogable rules such as the right to life, disallows us from consider those events as aberrant and thus exceptional. Despite the expansion of human rights norms in the WWII period, the equation of refugees with 'rightless' reveals the limits of these norms. The so called 'refugee crisis' constitutes in fact a crisis of the law itself. To understand these problems, I turn to the work of Hannah Arendt and Giorgio Agamben who highlighted that the phenomenon of 'rightless' far from being accidental constitutes instead a symptom of "the perplexities of the Rights of Man". Both Arendt and Agamben identified the inherent contradictions between state sovereignty and human rights and saw the refugee as the personification of such contradictions. Far from being an exception, the refugee constitutes in fact a systemic condition of an international order based on the power to exclude. I additionally turn to the work of Emmanuel Levinas and Judith Butler to provide the theoretical grounds on which the notion of responsibility could be extended to those considered as non-members within particular political communities and thus unravel our ethicopolitical obligations towards refugees.

L'hostilite - observable dans les multiples politiques anti-immigration - que les gouvernements europeens deploient a l'egard des refugies, des migrants et des demandeurs d'asile qui se presentent aux frontieres de l'Europe et les problemes concomitants auxquels ces personnes sont confrontees pour revendiquer et exercer leurs droits constituent une enigme contemporaine a resoudre. La frequence avec laquelle des migrants sont abandonnes a leur sort en mer Mediterranee et la quantite de derogations qui sont accordees a des droits non susceptibles de derogation - tel le droit a la vie - ne permettent pas d'aborder ces evenements comme etant des anomalies et, consequemment, comme etant des faits exceptionnels. Malgre le developpement des normes relatives aux droits de la personne depuis la Seconde Guerre mondiale, la representation des refugies comme des « sans-droit » revele les limites de la portee de ces normes. La soi-disante « crise des refugies » constitue en fait une crise du droit lui-meme. Pour comprendre ces problemes, je refere aux travaux de Hannah Arendt et de Giorgio Agamben, qui ont souligne que le phenomene des « sans-droit », loin d'etre accidentel, constitue plutot un symptome des perplexites des 'Droits de l'Homme'. Arendt et Agamben ont releve les contradictions inherentes entre la souverainete des Etats et les droits de la personne, et ils ont vu dans la figure du refugie l'incarnation de ces contradictions. Loin d'etre une exception, le refugie constitue en fait une condition systemique d'un ordre international fonde sur le pouvoir d'exclure. Je me base aussi sur les travaux d'Emmanuel Levinas et de Judith Butler, afin de fonder theoriquement l'argument selon lequel la notion de responsabilite devrait s'etendre aux personnes considerees comme des « non-membres » au sein de communautes politiques particulieres, permettant ainsi de clarifier nos obligations ethico-politiques envers les refugies.
