法國十七世紀的法學家讓·多瑪（Jean Domat）是法國民法史上最爲卓越的法學家之一，其最重要的貢獻即爲對民法的體系化。在法學教義逐漸走向"系統"和"科學"，最終到達法典的道路中，理解多瑪的學說可以從側面回答"什麼是法典化"這一問題。多瑪在人文主義法學、十七世紀自然法、理性主義和基督教倫理價值之間，找到了一條以"自然秩序"爲名，以"首要原理"爲前提的演繹法通路，並以義務和繼承作爲穿起整個民法規則系統的軸線。另外，其著作《自然秩序中的民法》也提供了一個羅馬法在近代"智識繼受"的樣本，既超越了《學說匯纂》，又不囿於蓋尤斯的三分法。多瑪的民法理論也正是因其系統和理論化而在十八世紀得到了發展和轉化，最終直接或間接影響了《法國民法典》和後法典時代的法學教義。.

520 $a Jean Domat, one of the most distinguished jurists in 17th century, his most important contribution was the systematization of civil law. Understanding Domat's "systematic" and "scientific" legal doctrine can help one answering the question of "what is codification". In humanist jurisprudence, seventeenth-century natural law theories, rationalism, and Christian ethical values, Domat found a way to interpret the law in the name of "natural order" and on the premise of "first principles," with Engagement and Succession as the two pillars of the entire civil law system. In addition, his work Les Loix civiles dans leur ordre naturel provides a sample of the "intellectual adoption" of Roman law in the modern era, which goes beyond the Digest and is not confined to the Gaius' tripartite of law. It was precisely by virtue of its systematization and theorization that Domat's theory of civil law was developed and transformed in the 18th century, ultimately influencing, directly or indirectly, the French Civil Code and post-code jurisprudence.
