Divorce mediation has gained a prominent place as a preferable alternative to the adversarial process for settling disputes relating to separation, divorce, child custody, parenting, and marital properties. Divorce mediation should enhance problem-solving skills among the divorcing parties and should promote collaboration and communication among the stakeholders of the dispute. Researchers have suggested the general public has viewed mediation, rather than litigation or an adversarial approach, as a more empowering means of conflict resolution that will likely produce a better adjustment of the stakeholders in divorce compared to that offered in litigation or the adversarial approach. Mediators are regarded as facilitators, and they frequently find themselves in the practical ethical dilemma of a third-party interventionists. Divorce mediators should navigate through and operate under the framework in which ethical standards of neutrality and self-determination are followed. Divorce mediators are afraid of using leadership behaviors while mediating due to the need to maintain consistency with the standards rather than violate the ethical standards of neutrality and self-determination during mediation. Thus, issues with reconciling leadership implementation and ethical standards have emerged. The general problem was divorce mediators' use of power through leadership behaviors to influence outcomes in a mediation session might violate ethical standards and could lead to incomplete or unsatisfactory outcomes for one or both disputing parties. In this study, this researcher addressed this problem by describing and explaining how divorce mediators in New York City area used leadership behaviors to resolve conflicts during divorce proceedings while avoiding any violation of the neutrality and the self-determination ethical standards of mediation.
