This study examined the lived experiences of judges and prosecutors making pretrial decisions in the state of Haiti, including their approaches to pretrial decision making and the resulting disparities within the state penitentiary system. Additionally, the factors influencing their pretrial decisions and the means of accounting for disparities were examined, along with pretrial decision making in the presence of public safety challenges and the exercise of individual discretion and authority in the decision process. This study used an interpretive qualitative phenomenological method, combining inductive reasoning with primary data collected from a purposive participant-centered sample. The sample was selected to study judges' and prosecutors' considerations of influencing factors when engaging in pretrial criminal and correctional justice in Haiti. The theoretical component of this study was based on Gottfredson's decision-making theory. The researcher collected the data using semistructured interviews, including open-ended and guided questions. To maximize credibility and validity, the researcher consistently utilized bracketing, epoche, and reduction in the collection, analysis, and assessment of the data. Efforts were made to collect sensitive personal information from the participants. The 10 participants originated from criminal courts in 18 Haitian jurisdictions. Government commissaries and judge instructors around the country served as participants or facilitators, with facilitators providing access to the participants and the facilities. This allowed the collection of credible data from individuals with at least three years of daily experience with the pretrial decision-making process in Haiti. The findings of this study revealed a power-driven approach to pretrial decisions, which is based on judges' and prosecutors' lived experiences within a criminal justice system overwhelmed with power disparities, as a result of irrational pretrial decisions, under the influence of recessive or dominant factors.
