This thesis examines public debate surrounding the contentious nature of chandelier bidding and its use in the New York fine art auction room. Chandelier bidding is the acceptance of imaginary bids---as if off the chandelier---instigated by the auctioneer on behalf of the seller and is also known as 'phantom bidding,' 'running,' 'consecutive bidding,' 'bidding off the wall' or 'pulling bids from the air.'

520 $a This thesis begins with an overview of the history and understanding of chandelier bidding, which is then reinforced with a study of the perception of chandelier bidding in the media for the period 1980 through July 2013. It concludes with an examination of the current law that regulates the practice and includes case studies of a commission undertaken by the New York City Department of Consumer Affairs and the New York Legislature's public hearing into practices regarding the auction industry. In conjunction with an analysis of the development of ten bills presented to the New York State Legislature, the thesis provides insight into both the practice and legislature attempts at reform.
520 $a This thesis concludes that, in certain circumstances, while the use of chandelier bidding is complex and confusing, present legislation adequately regulates the practice, and further enquiries are a misdirection of both time and resources that could be utilized on other questionable practices, such as irrevocable bids, third-party guarantees, and issues relating to art as an investment or security.
