This thesis challenges the factual situation of inequality and discrimination against Chinese women in a socialist regime labelled as having complete gender equality. In observing the 1980 Marriage Law and analyzing the recent divorce trend in Chinese society, this thesis explores individual and social factors that have a strong impact on Chinese marital relations. It also deals with a theoretical debate on an assumed conflict between legal principal and socialist morality, that emerged in the current divorce trend.

It argues that the failure of women's formal equality rights to realize substantive equality must be seen in the context of the Chinese state, and the relationship between socialism and feminism.
