Employment discrimination based on personal characteristics of an individual has been deemed illegal through passage of Title VII of the Civil Rights Act of 1964. Yet, despite nearly a half century of federal protection from such discrimination, it is still legally acceptable to discriminate against employees based on sexual orientation and/or gender identity. The Employment Non-Discrimination Act, or ENDA, is pending federal legislation that would make such discrimination illegal in the same fashion as Title VII. However, passage of ENDA has been elusive for nearly two decades. This research study explores the history of discrimination against lesbian, gay, bisexual and transgender employees (LGBT); the proposed legislation to halt such discrimination; theories regarding the challenges to ENDA by its opponents; advancements made in LGBT civil rights; and the future of the proposed legislation.
