This study examines the history of war crimes trials. Through a comparative study of the ICTY, ICTR and the Gacaca Courts of Rwanda it is determined that localized war crimes trials are the optimal justice mechanism for post conflict Afghanistan. This paper goes on to explain the manner in which the Constitution of Afghanistan and Shari'a law may be applied to Taliban war crimes.
