This dissertation examines the crown's policy towards papal provisors during the reign of Richard II as evidenced through prosecutions under the statutes of provisors and premunire and in the context of the Great Schism. Although many scholars have written about the statutes, none, before now, has done a search of the actual prosecutions found in the plea rolls of either the king's bench or common pleas. This study argues that the enforcement of the statutes of provisors and premunire during the reign of Richard II satisfied domestic priorities without impeding foreign policy objectives. The crown used the statutes of provisors and premunire primarily to regulate appointments to ecclesiastical benefices but also to defend the jurisdiction of the common law courts. Prosecutions were often political acts for social control rather than the neutral enforcement of the law to punish offenders. Those targeted for prosecution under the statutes of provisors and premunire during the reign of Richard II and the policy issues surrounding the prosecutions are examined. The dramatic, and heretofore unexplored, explosive growth of licenses to sue in Rome between 1389 and 1390 is also investigated. This study also outlines the political context in which the statutes of provisors and premunire were passed and enforced. Despite the apparent anti-papal nature of the statutes of provisors and premunire, the crown steadfastly supported the legitimacy of the Roman pope during the Great Schism. The deterioration in Anglo-papal relations over the questionable tactics used by the papacy under Urban VI and Boniface IX to collect money and nullify English law resulted in the second statute of provisors and third statute of premunire. Extensive appendices give details from provisor and premunire cases before the king's bench from the reign of Richard II.Subjects--Topical Terms:
