The paper focuses on foreign-affiliated in China, and uses the framework that is based on a wide conception of the labor-management-government relations and its surrounding environment, to do research on the causes of frequent labor disputes.

It is the commonly-held view that employer infringement on labor's right is the main direct cause of frequent labor disputes. Based on the study's results, a governmental policy that provided the imbalance in the right of labor-management is the main indirect cause of frequent labor disputes. The changing political thought and the implementation-related problem of the policy of the introduction of foreign capital is the main environmental of cause of frequent labor disputes. The intersection of the causes in different sphere led to the frequent labor disputes.

A measure devised to deal with the frequent labor disputes was strengthening the typical role that ACFTU working class representative. The ACFTU's representation rights in foreign-affiliated firms were strengthened. But, the problem still exists that ACFTU formation at foreign-affiliated firms can't represent completely the working class.

The paper studies the All-China Federation of Trade Union's position and its role on labor disputes from legal and actual standpoint. It sets forth the cause of ACFTU inability to represent completely the working class and closely links this with the history of ACFTU and Chinese political and economic system. ACFTU has from the start been attached to the organization of the Communist Party of China. It became a quasi-official agency since 1949 when the Communist Party of China became a governing party.

Lastly, based on the theory of “superstructure” and “foundation”, the paper presents a discussion on a reform bill in the improvement of ACFTU's constitution for adapting itself to the market economic system, and proposes the possibility that the reform bill is put into practice.
