This study explored improving due process procedures under Georgia's Drug Free Work-force Program in an unemployment insurance compensation benefits hearing when claims are disqualified as a result of a positive drug test. Two questions were addressed: (1) What are the due process steps and procedures required by Georgia, by national and state statutes, and by case law that are applicable when unemployment compensation benefits are denied because of a positive drug test? (2) Are there some due process procedural problems that Georgia Department of Labor Appeals Tribunal Administrative Hearing Officers encounter in drug-test-based firing and subsequent denial of unemployment compensation benefits? The first question was addressed through a review of Georgia's, eight regional states', and federal decisional law. The second question was addressed through a questionnaire survey of the Administrative Hearing Officers in Georgia.
