The moments between technological ideation and adoption are pregnant with possibilities for changing the course of human endeavor-interjecting third-party visions of a different life that can mediate individual autonomy. New consumer neurotechnologies offer liberating avenues of human engagement that bypass outward expressions of mental states (preferences, thoughts, and emotions) with direct data collection through brain-interfacing technologies. However, while beneficial in clinical applications and regulated in that context, the use of neurotechnologies in everyday consumer products such as EEG and EMG-enabled wearable devices pose serious concerns about individual autonomy, free thought, and privacy. This dissertation assesses the current state of consumer neurotechnologies and their risks and shows that potential harms are foreseeable and well-documented. While thus far national law and policy in the US has lagged technological developments in this area, policy is not absent. Circumscribing moments of technological innovation are hard and soft laws that range from incentivizing to prohibitive. This range of permissiveness makes up the regulatory landscape of technological development. This work analyzes that regulatory landscape to assess a pathway for neurotechnology policy in the US using two tools for institutional analysis derived from the Bloomington School of Institutional Economics. The Institutional Analysis and Development framework is used to analyze case studies and case law to determine 'the path for consumer neurotechnology policy in the United States.' A distinct tool of an IAD analysis, the Institutional Grammar is used as a method of content analysis to analyze US policy documents and peer reviewed articles on neurotechnology policy to assess 'the state of neurotechnology policy and what regulatory issues require attention to advance rights-preserving neurotechnology policy.' Culled from these multiple data sources, the dissertation provides an actor-network-based analysis of 'who should do what and how' and points to possible broad and narrow approaches for minimizing the risks from brain-intervening technologies in consumer products.
